Michael Savage sued... again
Robert Greenwald's Brave New Films is suing Michael Savage after the evil San Francisco talk host bullied YouTube into removing over 200 of their videos and disabling their account.
"It's the ultimate irony that a raging bigot like Michael Savage, whose hate speech is protected by the Constitution, is trying to censor Brave New Films," said Greenwald, "Savage is using the law to bully his detractors. It's not working."
The video at issue was Michael Savage Hates Muslims.
Using copyrighted material in limited amounts for the purposes of criticism is a textbook case of fair use.
Only last summer, Savage lost an earlier case against the Council for American-Islamic Relations (CAIR). In July, a U.S. District Court found that CAIR's use of a four-minute audio clip taken from a broadcast to criticize Savage's anti-Muslim statements was legally fair use. The case was dismissed.
Robert Greenwald, a film director and producer has recently formed a partnership with The Young Turks to provide live coverage of political events via streaming video.

Savage on the tsunami: "I wouldn't call it a tragedy. ... We shouldn't be spending a nickel on this" — Listen

Greenwald is suing the wrong entity. Savage does not have the power to remove anybody's YouTube account. The decision to remove accounts is the prerogative of the website owner, Google.
Phil Newmark, a producer at Talk Radio Network, said on behalf of Savage, "Michael never sent a complaint to YouTube about anything. This did not come from him in any way, shape or form." Newmark said he had no information about where the complaint originated. He said depositions and subpoenaed YouTube complaint documents for the civil suit will confirm that fact.

I have a hard time seeing how this suit is worth anything.
Obviously fair use precludes him from suing BNF but
Michael Savage can request YouTube take down anything. Michael Savage can request to fuck Hilary Clinton. Michael Savage can request a different table at Wendy's. The decision to honor those requests is YouTube's, Hilary Clinton's and Wendy's.
It sounds like BNFs beef is with YouTube ... and I'm not even sure on what grounds they could sue YouTube for YouTube deciding to stop allowing a third-party access to YouTube owned property (in this case, servers) ... obviously this is a publicity lawsuit. On that front I'm sure it will work marvelously, though.

For some reason, I think I'll let Greenwald and his lawyers try this case. I'll be interested in the outcome and hopefully Wiener/Google will not win by running Greenwald out of money fighting this "fair use" case.
BTW, doubtful that Google would care if the weener weren't whining.
BTW, is all law based on the Bill of Rights? What about the Federalist Papers, Constitution itself, case law? Others?
What's the point of any "fair use" law if it has to be in the Bill of Rights to be enforced? Just looking for some clarity, please.

Gosh, I am sitting at home all relaxed when some Gov Gregoire volunteer calls my house. No one likes these solicitation calls (they turn off more then they convert) when some older woman (at least she sounded old) starts to ramble on about the benefits of Gov Gregoire and her administration.
I politely wait until she pauses for a breath and ask, 'What about the accomplishments in regard to Transportation. We have no plans for the 520 and the ViaDuct is still a disaster waiting to happen.'
In the background I can hear an older woman starting to scream in tourette syndrome fashion 'where is my Fruitcup, Sparky' while the uninvited caller tries to answer my question with 'It is the fault of Dino Rossi...' to which I reply, 'but he hasn't been in office for 4 years. In addition, you have had a Dem Legislature for the last 6 years if not longer.'
I then asked, 'What about the Key Arena and why she wouldn't work with fellow Dem Mayor Greg Nickels. Is that Dino Rossi's fault?'
Well according to this solicitor it was actually not only Dino Rossi but George Bush.
After a bit of this and then the comment on Karl Rove I got bored and hung up.
Does ANYONE really think this kind of crap works? You want to get out and ring doorbells, great. But bothering people with phone calls is something no one likes. It's a step above the bumper sticker. a small step.

Two weeks before the financial collapse of the United States, a collapse that has been masked just enough to lull the sheep into a sense of security for the next 3 weeks, I warned everyone on this blog what was about to happen. Poor Gay Gary gets no laudits for his prescience.
After that happened I told everyone about the mass rapes, riots and crime sprees that would sweep this country - coast to coast - in a few short weeks after the mask falls off.
And we still have some morons out there pretending as though things like a silly election matter at all. They're like the orchestra playing on the deck of the Titanic as it slides softly underwater.
Instead of phone banking for chrissakes, your time would be betters spent preparing how to minimize the number of times you'll be raped, stockpiling 1800 calories per day in rations and making preparations for a total and complete social collapse.
This country is populated by a happy cabal of morons.

Here is another case that should be followed closely. Could Hussein be hiding something. Why will he not produce the proof of his citizenship. All it would take is a "Birth Certificate". Certainly Hussein has one of those right. Or maybe not.

I'm not obsessed, I'm simply trying to provide a public service. I suspect many of the people who will shortly be subjected to gang-rapes and other physical assaults in a few weeks after System Collapse occurs will undergo extreme mental anguish prior to starving to death. They'd be well cautioned to steel themselves in advance. If their personal ethos precludes them from purchasing a firearm, that's fine, but in that case they'd simply be well advised to stock up on various personal lubricants.
I'm really not trying to be graphic, and I apologize if this is, I simply think it's best to talk about it before it happens than spend time comisserating after the fact because one wasn't prepared.
